Conditions to be fulfilled by the purchaser

1- The Purchaser

The Purchaser is the person to whom a batch has been allocated. In case of dispute,only the bailiff present at the auction may decide whether or not the batch will be put again for auction.

Every purchaser is considered in relation to Hotel des Ventes St Georges to act in his own personal name,even for batches he would have acquired as proxy

2.Selling price and copyright charges.

 The Purchaser will pay to Hotel des Ventes St Georges the price of the auction,increased by 22% for expenses,for all catalogued sales and 25% for unlabelled sales.In accordance with the law of june 30,1994 imposing a duty on all auction sales of works of art to the benefit of artists and author of the works on sale, the purchaser will have to pay in addition to the selling price a copyright charge amounting to 4% for all works sold at a price of BF 50,000 or Euros 1,240  and over, the copyright charges will be abolished if the artist has been deceased for more than 70 years.

Payment-Invoicing - V.A.T

As soon as a batch has been allocated to a purchaser,he is to assume all risks,and he will have to pay the price. Payment will be cashed in Belgian currency ,Hotel des Ventes st georges accepts checks that have been certified by a Belgian bank.

Request for invoicing will have to be made at the latest on the fifth day of the week following the auction.

On all our sales to a citizen of the E.E.C,V.A.T will not be refundable,and is not deductible.

Removal of batches

Batches will not be taken away during the sales. The have to be removed during the three working days following the sales and after full payment.All unremoved batches within the specified time will be stored at cost for the Purchaser.

Hotel des Ventes St Georges cannot be held responsible for losses or damages incurred to the batch, even if they are due to carelessness,on his behalf.

Conditions relative to the depositor

Except for particular agreements, the putting up for sale will be carried out at the following conditions:

A 12% commission of the proceeds of the sale.The depositor will be responsible for transport.

Payments will be made within 12 working days after the sales without any notification of  consignment voucher,provided the auctioned batches have been paid by the purchaser.

After signature of the present contract,all batches set down may not be taken away or removed from the sales for whatever reason,before their first auction day’s sale.
